1. Acceptance of Terms

By downloading, installing, or using the Tabits mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legal agreement between you and Workout Notes ("we," "us," or "our"), the developer of Tabits.

2. Description of Service

Tabits is a Tabata and interval timer application designed for high-intensity interval training (HIIT) workouts. The App allows users to:

• Create and customize interval timers
• Use preset workout timers
• Track workout rounds and intervals
• Receive audio and haptic feedback during workouts

3. User Responsibilities

Health and Safety

Important: Tabits is a timer tool and does not provide medical, health, or fitness advice. Before starting any exercise program, you should:

• Consult with a qualified healthcare provider
• Ensure you are physically capable of performing high-intensity exercises
• Warm up properly before workouts
• Stop exercising if you feel pain, dizziness, or discomfort

You acknowledge that you use the App and perform any exercises at your own risk. We are not responsible for any injuries or health issues that may occur during or after your workouts.

Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Modify, adapt, or create derivative works based on the App
• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems or networks
• Distribute or share the App outside of official app stores

4. Intellectual Property

The App, including its design, features, code, graphics, and content, is owned by Workout Notes and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

5. Third-Party Services

The App uses third-party services including Google Firebase for analytics and crash reporting. Your use of the App is also subject to Google's terms and policies. Please review our Privacy Policy for more information about data collection.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORKOUT NOTES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits or revenue
• Loss of data
• Personal injury or property damage
• Any damages arising from your use or inability to use the App

Our total liability for any claims arising from or related to the App shall not exceed the amount you paid for the App.

8. Indemnification

You agree to indemnify, defend, and hold harmless Workout Notes and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party

9. Updates and Modifications

App Updates

We may update the App from time to time to add features, fix bugs, or improve performance. These updates may be required for continued use of the App.

Terms Updates

We reserve the right to modify these Terms at any time. Changes will be effective when posted on this page with an updated "Last updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.

10. Termination

You may stop using the App at any time by uninstalling it from your device.

We reserve the right to terminate or suspend access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Spain.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Workout Notes regarding your use of the App and supersede any prior agreements.
